As we welcome 2025, we are thrilled to share exciting news about what lies ahead for Chapman Law Review. This year, we will publish two general issues of Volume 28 and our much-anticipated Symposium Issue!

Kicking off the year, our first General Issue will be released by the end of January 2025, featuring outstanding scholarship from leading legal minds. Stay tuned as we continue to share updates and insights throughout this exciting new chapter.

This year’s Volume of the Chapman Law Review is

This year’s Volume of the Chapman Law Review is dedicated to the memory of Chapman’s late professor, Nancy L. Schultz, known to her students simply as Nancy. We sadly and unexpectedly lost Nancy on December 15, 2023. Although we continue to feel the tremendous void of her presence in the halls, she leaves a lasting legacy at our school and across the globe. Nancy, who also served on our law review’s faculty advisory committee, taught at Chapman for 27 years and positively impacted the legal careers of thousands of students here and abroad.

Two Chapman professors, John Bishop and Lawrence Rosenthal, pay tribute to Nancy in this edition of the journal. In the first piece, Professor Bishop touches on Nancy’s lasting impact as the head of Chapman’s competition teams, including Mock Trial, Moot Court, and Alternative Dispute Resolution, for nearly three decades. Chapman’s halls are filled with trophies and other accolades won by Nancy’s teams over the years because of her dedication to coaching and mentoring, working tirelessly to help her students succeed. The second piece, written by Professor Lawrence Rosenthal, discusses Nancy’s scholarship, and her transformative solutions for teaching and training law students. One of Nancy’s mantras was “Words Matter,” which encouraged students to simplify their legal writing and advocacy, sharpening students’ skills and preparing them for real-world practice.

We are forever grateful for Nancy. We miss her (and her signature fist bumps) very much, and we hope to carry forward her legacy and make her proud.

We look forward to publishing Catherine Le's article, Major Questions in Crisis Governance. In this article, the author retheorizes the major questions doctrine as rooted in presidential plebiscitary legitimacy. She argues that this modified major questions doctrine will be capable of upholding the administrative ability to respond effectively to unprecedented, rapidly evolving emergencies (e.g., COVID-19) while preventing overreach by meaningfully cabining executive power.

We look forward to publishing Professor Rebecca Bratspies's article, Building the World We Want in an Era of Climate Anxiety, in our forthcoming journal (Volume 27). In this article, Professor Bratspies embarks with the notion that we must reject climate doomism and highlights how grassroots action and local laws, like those enacted in New York, can effectuate positive change in combatting climate change. The article is based on a presentation Professor Bratspies gave at Chapman’s 2023 Contemporary Conversations in Climate Change Symposium.

We look forward to publishing Grace LeBlanc's note, The BEPS “Revolution” and the Future of Corporate Income Taxation, in our forthcoming journal (Volume 27). Below, you will find an overview:

This Article explores how tax-motivated profit shifting by multinational corporations is regulated within national and global tax systems. It argues that despite recent radical changes in the tax treatment of multinational corporations, tax competition and the entrenchment of power dynamics between wealthy and developing countries continue to undermine international cooperation toward tax fairness.

We look forward to publishing Tyler von Denlinger's note, Protecting Personal Dignity: Advocating for a Federal Right of Publicity Against Pornographic Deepfakes, in our forthcoming journal (Volume 27). Below, you will find an overview:

This article examines the prevalent issue of pornographic deepfakes, exploring their rise, impact on victims, and the flaws of existing regulations. Currently, federal and state laws are inadequate in addressing the harm caused by non-consensual deepfake pornography, particularly due to the broad immunity granted to internet service providers who host such content. By proposing a federal right to privacy, the article aims to provide victims with a legal avenue to remedy the dissemination of deepfake pornography.

We look forward to publishing Kaelyn Timmins-Reed note, Crayons, Contests, & Copyright: Contracting to use a Child’s Creative Work, in our forthcoming journal (Volume 27). Below, you will find an overview:

Minors can create copyrighted works, and as their access to technology expands, they are ever more encouraged to do so. Companies like Target and Google seek to use minors’ copyrighted works, but contracting with minors can be difficult because they can void contracts under the common law infant contract doctrine. This Note explores the law surrounding contracting with minors to license a copyrighted work or create a work made for hire and suggests solutions to empower minors to protect their copyrights.

We look forward to publishing James Crisafulli's article: “Individually Minor But Collectively Significant”: The Right to Cumulative Impact Analyses and Substantive Protections in Wilmington, California, in our forthcoming journal (Volume 27). Below, you will find an overview: James’s paper thoroughly evaluates the disproportionate air pollution impacts on the residents of Wilmington, California, and argues that procedural and substantive mechanisms should be applied to relieve them of cumulative impact burdens from several neighboring sources of pollution. His article evaluates gaps in applicable federal and state environmental impact assessment mechanisms–and draws on cumulative impact protection mechanisms in other countries–to propose an innovative and compelling response to a pressing environmental justice issue in Southern California. We look forward to publishing Professor James Phillips’s article, A Corpus Linguistic Analysis of “Possession” in American English, 1760-1776, in our forthcoming journal (Volume 27). Below, you will find an excerpt from the article’s introduction:

The U.S. Constitution’s Fourth Amendment protects against unreasonable searches and seizures of persons, houses, papers, and effects. Yet state constitutions often use different language, thus providing a different scope of protection. Specifically, starting with Pennsylvania in 1776, sixteen states have constitutional provisions that include possessions as protected from unreasonable searches and seizures. And currently there is litigation in various state courts, including the Pennsylvania State Court, over the meaning of this constitutional protection.
